The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas military commander Mohammed Deif, for their alleged involvement in war crimes and crimes against humanity during the ongoing conflict between Israel and Hamas.



The decision came after a pre-trial chamber of judges rejected challenges from Israel regarding the ICC&#8217;s jurisdiction. 



The court found &#8220;reasonable grounds&#8221; to believe that all three individuals bear criminal responsibility for their actions amid the violence that erupted after Hamas&#8217;s attack on southern Israel on October 7, 2023, which resulted in approximately 1,200 Israeli deaths and numerous hostages taken to Gaza.



While Israel asserts that Deif was killed in a July airstrike, the ICC has stated it cannot confirm his status. 



The warrants reflect the ICC prosecutor&#8217;s findings that Deif is responsible for multiple crimes, including murder, torture, and sexual violence, as part of a systematic attack against the civilian population of Israel.



For Netanyahu and Gallant, the ICC claims they share criminal responsibility for the war crime of starvation as a method of warfare and other inhumane acts directed against civilians.



In response, Israel&#8217;s prime minister&#8217;s office condemned the ICC&#8217;s actions as &#8220;antisemitic&#8221; and a &#8220;modern Dreyfus trial,&#8221; asserting that Netanyahu will not yield to pressure and will continue to pursue military objectives against Hamas.



Israeli President Isaac Herzog described the ICC&#8217;s decision as &#8220;outrageous&#8221; and accused the court of siding with terror over democracy. 



Meanwhile, Hamas welcomed the warrants as a significant historical precedent and urged countries worldwide to enforce them and address what they call genocide against Palestinians in Gaza.



The effectiveness of these warrants will largely depend on whether the ICC’s 124 member states, which do not include Israel or the United States, choose to act on them. 



The ICC, established in 2002, prosecutes individuals for genocide, war crimes, and crimes against humanity.
